Welcome to Picfre.com (hereinafter referred to as the "Service"), an online data service that provides users with AI-generated image and video titles and keywords. These Terms of Service (hereinafter referred to as the "Terms") govern your access to and use of our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
The Service is available to users worldwide. By accessing or using the Service, you represent and warrant that your use of the Service is in compliance with all applicable laws and regulations in your jurisdiction. You agree to be solely responsible for ensuring that your use of the Service is legal in your country of residence or from your location. Your use of the Service shall be deemed as your acknowledgment that there is no conflict between your local laws and regulations and our Terms of Service.
picfre.com allows users to provide their images or videos ("User Content") through the client. The Service then uses artificial intelligence to generate titles, descriptions, and keywords ("Generated Metadata") for the User Content. For each successful generation of Metadata, a record containing the file name and transaction time will be created for billing purposes.
Service Fees: Using the AI processing features of the Service requires payment of fees. Each time AI titles and keywords are successfully generated for a piece of User Content, fees will be deducted from your account balance.
Recharge: To use the paid services, you must add funds to your account. The minimum recharge amount is $10.00 USD.
No Refunds: All payments and recharges are final and non-refundable. Once funds are added to your account, they cannot be withdrawn or refunded.
Billing Records: For each transaction involving AI processing, we will record the file name of the processed User Content and the transaction timestamp. This information will be used for billing and service management.
Compliance with Laws: You agree to comply with all applicable local, state, national, and international laws and regulations when using the Service.
User Content: You retain ownership of all User Content uploaded to the Service. We do not claim any ownership rights to your User Content.
Generated Metadata: You shall own the Generated Metadata (titles and keywords) created from your User Content through the Service.
Our Service: Picfre.com retains all right, title, and interest in and to the Service, including all related software, technology, and documentation, and any future enhancements or modifications.
You acknowledge that title and keyword generation is performed by AI. While we strive for accuracy and usefulness, picfre.com does not guarantee the accuracy, relevance, or quality of the Generated Metadata. The AI outputs are provided "as is".
You acknowledge that the Service uses a serverless architecture. This means that data processing and storage may be distributed across various servers and locations managed by our cloud providers. We take measures to ensure the security and integrity of your data within this architecture.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, picfre.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE (WHETHER DIRECT OR INDIRECT), OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE ASSETS, ARISING OUT OF OR RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING GENERATED METADATA; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
picfre.com reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. You are advised to review these Terms periodically for any changes. Changes to the Terms are effective when they are posted on this page. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of and agreement to the changes.
picfre.com may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of your country of residence, without regard to its conflict of law provisions.
